There is public hearing is concerning a request to amend the official zoning map to rezone approximately 45.46 acres, located on the northwest corner of the intersection of Interstate Highway 10 Frontage Road and John Martin Road, legally described as Tract 1, Block 46, Elena Fruit & Cotton Farms C, Harris County, Texas, from an Open Space/Recreation (OR) Zoning District to a General Commercial (GC) and Mix Residential at Low-to-Medium Densities (SF2) Zoning District. This public hearing will be on Monday, November 19, 2018. The staff report states; The applicant is proposing to rezone a parcel which was recently involuntarily annexed from Open space/recreation (OR) to General Commercial (GC) and Mix residential at low to medium densities (SF2). The property has frontage along Interstate Highway 10 (IH10) which has commercial uses at three corners; rezoning this property will complete what is essentially a commercial node. The portion of the site that has frontage on IH10 is designated as a commercial corridor and is in line with the Future Land Use Plan (FLUP). The applicant is requesting that the portion towards the rear of the site be considered for a Mix residential at low to medium densities (SF2) designation. The rear portion has a FLUP designation of Low-Medium Density Residential. The acreage of this site lends itself to split zoning the parcel. Following this request with a corresponding plat will clearly identify boundaries and the applicability of the required compatibility standards between commercial and residential zones. This
request is compatible with the FLUP. In order to recommend approval of an application for a zoning amendment, the Planning and Zoning Commission shall consider the following factors:
The parcel has frontage along IH10 and has the potential to access municipal utilities that may be extended to serve all proposed uses. Any proposed development will be required to meet all current codes which promote the health, safety, and welfare of the community. The subject tract was recently involuntarily annexed. The frontage of the site is positioned at an intersection where commercial uses are at every other corner along the IH10 10 frontage. The site is compatible with its neighboring parcels in use, aesthetics, and density. The proposed rezoning would allow for a commercial node and provide a basis for continued commercial growth along the IH10 frontage. The rear of the site is positioned adjacent to residential. The site is compatible with its neighboring parcels in residential development potential; all residential regulations such as density and masonry will be applied for any residential structure within the zoning district. The proposed rezoning would allow for a residential use and be compatible with our FLUP designations. Following this request with a corresponding plat will clearly identify boundaries and the applicability of the required compatibility standards between commercial and residential zones. This request is compatible with the FLUP. Includes a range of existing residential uses from rural residential to limited multifamily residential. Primarily conventional, single-family detached dwellings and manufactured housing on platted lots; smaller lots are satisfactory if common open space is provided. The scale and mass of any multi-family development should be reviewed and considered for compatibility with neighboring uses. Uses including places of assembly, schools, parks, and other community facilities such as libraries with pedestrian links to residential. Commercial that serves neighborhoods – not regions, such as office buildings, and neighborhood services to support and compliment the residential area. Small-scale, neighborhood commercial located within a convenient walking distance of residences and buffered when adjacent to a residential use. Appropriate area for pedestrian and bicycle-friendly streets. Medium density development along the perimeter of neighborhoods and generally along collector streets.
May accommodate all types of commercial activity, including “big box”, medical services, restaurants, entertainment, offices, and large multi-family development. Corridors of commercial activities with variable depths along or near major arterials and freeways. Improved traffic mobility by discouraging continuous commercial strips with numerous driveways along major streets. Commercial corridor proposed along the east side of Wade Road, south of IH 10, as a buffer between existing rail yards west of Wade Road and proposed residential use to the east toward Goose Creek. And; Residential uses are appropriate according to the FLUP Land Use Narratives. As a guiding document, the Baytown 2025 Comprehensive Plan Future Land Use Plan (FLUP) provides the logic behind decisions about land use with regard to regulation i.e., zoning. The request is consistent with the FLUP as the subject property is designated as Commercial Corridor and Low-Medium Density Residential. Commercial uses are appropriate according to the FLUP Land Use Narratives.
