Charges of Interfering with Public Duties area also pending through the Harris County District Attorney’s Office against Garcia


On May 21st at 10:30 a.m., officers were dispatched to a minor accident in the area of Interstate 10 and Main Street. Upon arrival officers found the accident involving two vehicles, a SUV passenger vehicle and a dump truck. As officers were talking with the female driver of the SUV to try to determine what happened, the driver of the dump truck, later identified as Fernando Garcia, walked up and began interrupting and trying to convince the female driver of the SUV that there was no need for police and he would pay her cash for the damages, which the driver of the SUV declined and insisted on a police report. Officers asked Garcia numerous times for his driver’s license and insurance, which he refused to provide and instead ignored officers and started taking pictures of the SUV. After asking Garcia at least seven times for his license and insurance and him failing to provide it or cooperate with the officers, they decided to place Garcia under arrest. Upon doing so Garcia attempted to walk away from the officers while trying to pull his arm from their grasp. Garcia continued his lack of cooperation and failure to comply with the officers even after they were able to place him in custody by resisting being walked to a patrol car. Once officers were able to get Garcia to the patrol car he refused to get in as he continued to yell at officers. Eventually, with the assistance of other officers, Garcia was placed in the patrol car and transported to the Baytown Jail where he was booked for Failure to  Identify and Failure to Change Address on his Driver’s License. Charges of Interfering with Public Duties area also pending through the Harris County District Attorney’s Office.
