On February 18th at 1:52 a.m., officers attempted to conduct a traffic stop on a vehicle in the area of North 10th street and East Texas. As the officer activated his emergency equipment on his patrol vehicle the suspect began attempting to elude the officer, ignoring the officers lights and siren. As officers attempted to get the vehicle to stop, they were advised that the vehicle showed to be a stolen vehicle. The suspect continued to flee from officers, eventually coming to a stop in the parking lot of the McDonalds located in the 300 block of North Alexander. Once the vehicle came to a stop, the driver exited the vehicle and fled on foot as the officer pursuing on foot. At one point the suspect pulled a handgun from his waist band and discarded it before surrendering to officers commands shortly after. The suspect, now identified as 17 year old D’Anthony Payne, was then taken into custody during which officers located two small bags of marijuana in his pocket. Officers checked the area where he threw the handgun and recovered a loaded .40 caliber pistol. Payne was taken back to the vehicle, where other officers had a passenger, identified as 17 year old Aaron Heads, detained. Heads had climbed from the passenger seat into the driver seat as other officers arrived but was arrested before he could flee in the vehicle. Both were transported to the Baytown Jail where Payne was booked and charged with Felony Evading in a Motor Vehicle and Unlawful Carrying of a Weapon and Heads was charged with Possession of Drug Paraphernalia. Further investigation revealed that the vehicle actually belonged to Aaron Heads mother and had been reported stolen in January but had since been returned to her, however she failed to contact police to report it returned.
