On May 17th at 1:30 p.m., officers responded to a report of a disturbance in the 300 block of East Homan. Upon arriving officers found the suspect, identified as 42-year-old James Dagen, standing outside screaming and drinking beer. As officers tried to calm James down to talk to him he picked up a set of weights and started doing overhead presses and telling the officer he “better call backup”. James then dropped the weights and picked up two beers, slammed them together, and began chugging them, all while continuing to threatening the officer, shouting that he “better call back up”.
The officer then retrieved his K-9 partner while he waited for other units to arrive. Once other officers arrived and James realized the officer had a K-9, he followed commands to get on the ground, where he was taken into custody. Once in custody James began banging his head on the concrete, however, officers were able to get him off the ground and into a patrol vehicle before he could seriously hurt himself. As officers were placing James in the patrol car he began spitting on one of the officers. James was transported to the Baytown Jail where he was charged with Assault by Threat, due to the threats he made towards the complainant’s son, Public Intoxication, and Harassment on a Public Servant, which was filed through the Harris County District Attorney’s Office.
