Domestic Dispute Ends in Shooting


UPDATE:
Early this morning, as a result of the injuries she sustained during this tragic and senseless shooting, Ms. Payne succumbed to her injuries. Upon learning of Ms. Payne’s passing, Homicide Detectives contacted the Chambers County District Attorney’s Office and the charges against Mr. Posey have been upgraded to Murder.





UPDATE:
Baytown Homicide Detectives worked through the night conducting interviews and reviewing evidence uncovered during the course of their investigation into the senseless and tragic shooting of 39-year-old Christina Payne, which occurred yesterday evening in the 10500 block of Devinwood Drive. Early this morning Homicide Detectives presented those findings to the Chambers County District Attorney’s Office and as a result charges
of Aggravated Assault with a Deadly Weapon have been accepted and filed on 40-year-old Marquis Posey of Baytown, the father of Ms. Payne’s child.





Ms. Payne remains hospitalized and in extremely critical condition, thus the charges against Mr. Posey could be upgraded should Ms. Payne’s condition worsen.







On August 24th at approximately 7:40 p.m., Baytown Police responded to a residence in the 10500 block of Devinwood Drive in reference to a report of a shooting. Upon arrival, officers found 39-year-old Christina Payne of Pearland, lying in the driveway of the residence, suffering from what appears to be a single gunshot wound to the head. Officers attempted to render aid to Ms. Payne until Medical personnel arrived on the scene, and
subsequently, airlifted her to Herman Hospital in Houston.

Ms. Payne’s 40-year-old boyfriend was still on scene, along with what we believe to be the weapon used in the shooting. He was subsequently detained and transported to the Baytown Police Department to be interviewed by Homicide Detectives.

During the initial investigation, Detectives learned that Ms. Payne arrived at the boyfriend’s residence, where she was confronted in the driveway by the boyfriend. The two appeared to have some type of verbal altercation, during which the boyfriend displayed a handgun and shot Ms. Payne one time.
Detectives continue to investigate this shooting in an effort to uncover all the facts and circumstances and as such will be working throughout the night, interviewing witnesses and processing evidence uncovered at the scene to do so.

The boyfriend remains in police custody and charges against him are pending the outcome of our investigation. We hope to be able to provide an update later today on those charges, as well as the condition of Ms. Payne, who at last report was still undergoing surgery and in critical condition.
